Court Orders Kano State Govt to Refund Illegal Deductions from Pension

An Industrial Court sitting in Kano, has ordered the Kano State Government to refund illegally deducted amounts from monthly pension and henceforth stop further deductions.

The Presiding Judge, Justice E. D. E Isele, declared that, all deductions made in a Pensioner’s Monthly Pension by the Kano State Government were illegal and should be stopped and refunded immediately.

The Claimant, Badamasi Umar, who brought the case against the Kano State Government, which lead to originating summons on 31st December 2020, said that his Monthly Pension amounting to N82,112.01 had been tampered with and such actions should henceforth be stopped and funds illegally deducted should be remitted back to his account.

The Presiding Judge, ruled that his N95,464.80 monthly Pension should be guaranteed and shall not be withheld or altered in the light of section 210 of the Constitution of the Federal Republic of Nigeria (as amended).

The Presiding Judge also said as empowered by Section 210 (2) and (3) of the Constitution the Claimant who has been receiving a monthly Pension of N95,464.80 from the Defendants is entitled to an upward review of his monthly Pension after 5 years or review of minimum wage.

The Presiding Judge further ruled that, by virtue of the provisions of Section 6 of the Kano State Pension and Gratuity Law 2007, the Claimant is entitled to prompt payment of his monthly pension every month as at when due.

The Presiding Judge however declined the claim for damages, ruling that the Claimant and the Kano State Government should bear their own costs of the case.
