Court orders Jigawa State to pay N201 million Severance Gratuity

The Presiding Judge, Kano Judicial division of the National Industrial Court, Hon. Justice Ebiye Isele has ordered the Jigawa State Government, its Attorney General and Hon. Commissioner Ministry for Local Government to pay Hon. Sale Mato, Hon. Muhammad Ibrahim and 7 others representing themselves and former Councillors the sum of Two Hundred and one Million, Nine-Hundred and Twenty-One Thousand, Three Hundred and Forty-Eight Naira (N201,921,348.00) as full and final payment of their Furniture Allowance and Severance Gratuity for the period covering the year 2008 to 2016 that they served as councillors in their various Local Government Legislative Council in the State.

The Court entered the judgment in accordance with the terms of the settlement consented by both parties in substantial compliance with the rules of the court.

From facts, the claimants- Hon. Sale Mato, Hon. Muhammad Ibrahim and 7 others, representing themselves and former Councilors who served in various Local Government Legislative Council in Jigawa State between the year 2008 to 2016 had filed a suit against the Jigawa State Government and sought a declaration that having regards to the provision of the Local Government Public Officers (Remuneration, Salaries and Allowances) Law, 2008 of the Jigawa State, they were entitled to be paid by the Jigawa State Government the sum of Five Hundred and Thirty-Six Million, Two Hundred and Forty Thousand, Five Hundred and Sixty Naira (N536,243,560.00) being their Furniture Allowances and Severance Gratuity.

Likewise, a mandatory order directing the Jigawa State Government, its Attorney General and Hon. Commissioner Ministry for Local Government to forthwith pay them the Furniture Allowances and Severance Gratuity as provided by the Local Government Public Officers (Remuneration, Salaries and Allowances) Law, 2008 of the Jigawa State.

However, an amicable settlement was reached by both parties and agreed that the terms of settlement (upon execution thereof), shall be entered as judgment of the court and shall operate as a bar to any present or future action in respect of the subject matter of the suit against the defendants and any other Local Government in Jigawa State whatsoever.

Delivering the judgment, Justice Isele ruled on the terms of settlement as agreed by both parties and awarded no cost in the spirit of an amicable settlement.
